Terms of Service

Dash is a workspace for independent medical-device sales representatives — tray inventory, scheduling, and case notes & checklists. Dash is operated by JKNIGHTSELLS LLC (“Dash”, “we”, “us”). These Terms of Service (the “Terms”) are a binding agreement between you and JKNIGHTSELLS LLC. By creating an account or using Dash, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference.
1. Agreement to these Terms
You must be at least 18 years old to use Dash. Dash is a professional tool intended for business use. If you use Dash on behalf of a company or team, you represent that you have authority to bind that company or team, and “you” includes it. If you do not agree to these Terms, do not create an account or use the service.
2. The service
Dash provides a workspace for medical-device reps: surgical-tray inventory with photographs, hospital and surgeon records, case scheduling and forecasting, notes and checklists, and an optional AI assistant. Some features require a paid subscription; current plans and prices are listed on our pricing page. We improve Dash continually and may add, change, or refine features over time (see §16).
3. Not for patient information (no PHI)
Dash is designed and operated so that it never holds protected health information (“PHI” as defined by HIPAA, 45 C.F.R. § 160.103) — in plain terms: patient names, medical record numbers, dates of birth, diagnoses, surgery details tied to a patient, or photographs that include patients, charts, wristbands, or identifying signage. You agree that you will not enter, upload, or otherwise submit PHI to Dash in any field, note, checklist, photograph, or message to the AI assistant.
- No BAA. JKNIGHTSELLS LLC is not a HIPAA covered entity, does not act as a business associate, and does not offer a Business Associate Agreement at any plan level.
- Breach of these Terms. Entering PHI into Dash is a material breach. We may remove or delete such content and may suspend or terminate the account involved.
- Your responsibility. If you enter PHI in violation of this section, you are solely responsible for that information and for any consequences of placing it in Dash. No business-associate or similar relationship is created by such a violation.
4. Not medical advice; not a medical device
Dash is administrative software that supports the business operations of a sales rep — inventory, scheduling, and record-keeping. It is not intended for use in diagnosis, treatment, or any clinical decision, and it is not a medical device. Dash does not verify, certify, or warrant the completeness, sterility, or fitness of any surgical tray or instrument — your own count sheets, your manufacturer’s procedures, and the hospital’s processes remain the authoritative record. You are responsible for confirming any information in Dash before relying on it in your work.
5. Your account and teams
- Provide accurate account information and keep your sign-in credentials confidential. You are responsible for activity under your account, and each login is for one person — don't share credentials.
- If you create or join a team, your workspace content is shared with your teammates according to their roles, as described in the Privacy Policy.
- Team owners manage seats and invitations, and are responsible for their team members' compliance with these Terms. Team plans are billed per seat, as shown on the pricing page.
6. Subscriptions, fees & automatic renewal
Paid plans are billed in advance through our payment processor, Stripe, at the prices shown on the pricing page (in U.S. dollars), plus any per-seat or add-on charges you select and applicable taxes.
Your subscription renews automatically at the end of each billing period — monthly or annually, depending on the plan you chose — and continues until you cancel. You can cancel at any time from Settings → Billing (see §10). Where shown at checkout, a one-time setup fee applies to new subscriptions and is not part of the recurring charge.
If a renewal payment fails, we may retry it and notify you. If payment is not made after a reasonable period, we may downgrade the account to the free tier or suspend paid features until payment succeeds. Your data is not deleted because a payment fails.
7. Founding Rep pricing
Founding Rep accounts receive a discounted base rate — currently 20% off the standard base price of their plan — for 24 months from the start of the subscription, as long as the subscription remains continuously active. The discount ends early if the subscription is canceled or lapses for non-payment, and it applies to the base plan price only — not to per-seat charges, add-ons, or plans introduced later. A general price change under §9 does not affect an active Founding Rep rate during its term.
8. The 30-day guarantee & refunds
Monthly subscriptions come with our 30-day guarantee: if Dash hasn’t paid for itself in your first 30 days, email support@dashcheck.app within 30 days of your first subscription charge and we will refund that charge in full to your original payment method. The guarantee applies once per customer, to the first subscription payment on a monthly plan. The one-time setup fee is non-refundable.
Beyond the guarantee, fees are non-refundable and we do not prorate partial billing periods — when you cancel, you keep access until the end of the period you’ve paid for. The guarantee covers your subscription fee; it is not a warranty of any particular business outcome or of the accuracy of AI-assistant output (§13).
9. Price changes
We may change plan prices from time to time. If a price change affects your existing subscription, we will notify you by email at least 30 days before it takes effect, and it will apply from your next billing period after that notice. If you don’t agree to a new price, cancel before it takes effect (§10).
10. Cancellation
You can cancel your subscription at any time, online, from Settings → Billing → Manage subscription — no phone call or email required. Cancellation takes effect at the end of your current billing period; you keep full access until then, and you are not charged again. After cancellation your account continues on the free tier and your data remains in your account. Deleting your account entirely is separate and is described in §11 and the Privacy Policy.
11. Your content & data
- You own your content. Trays, photos, hospitals, surgeon records, schedules, notes, and checklists you create in Dash are yours. You grant us only the limited license needed to host, process, display, and back up that content in order to run the service — consistent with the uses described in the Privacy Policy — and we do not use it to train AI models.
- Export. You can view and work with your data in the app at any time, and you may request a copy of your data by contacting support while your account is active.
- Deletion. You can delete your account from Settings. Deletion is recoverable for 30 days — sign back in within that window to restore it — after which your data is permanently removed. Deleting your account also cancels any active subscription at the end of the current billing period.
12. Acceptable use
You agree not to:
- Use Dash in violation of law, or to store content you don't have the right to store — including PHI (§3).
- Probe, disable, or circumvent Dash's security or access controls, or access another operator's or team's data.
- Reverse engineer, copy, resell, sublicense, or white-label the service, or use it to build a competing product.
- Scrape the service, overload it with automated traffic, or use it to send spam or malicious content.
- Misrepresent AI-assistant output as human-generated, or use the assistant to attempt any of the above.
13. The Dash AI assistant
Some plans include an AI assistant that can read and search your own workspace to answer questions and remember details you tell it. It is assistive only: its answers are suggestions for you to confirm, not a system of record. AI output is probabilistic — it can be inaccurate, incomplete, or inconsistent between requests — and you must independently verify it before relying on it. Never use the assistant for clinical decisions or patient care, and never send it PHI (§3).
The assistant is subject to fair-use limits (including monthly usage caps shown in the app). It may be throttled, changed, or temporarily unavailable — Dash degrades gracefully when it is, and that is not a breach of these Terms. Details of how AI requests are processed are in the Privacy Policy (§5 there); your content is not used to train models.
14. Privacy
Our Privacy Policy describes what we collect, how it’s used, the service providers we rely on, and your choices. It is part of these Terms.
15. Third-party services
Payments are processed by Stripe under Stripe’s own terms and privacy policy; we never see or store your full card number. If you subscribe your external calendar (Google, Outlook, Apple) to your Dash schedule feed, your calendar provider’s terms govern that application’s handling of the feed.
16. Availability & changes to the service
We work to keep Dash fast and available, and we operate it with commercially reasonable care and skill — but we do not promise uninterrupted or error-free operation, and no uptime level is guaranteed. We may change, add, or remove features as the product evolves; if we remove something material to paid plans, we’ll give reasonable advance notice.
17. Suspension & termination
You may stop using Dash and delete your account at any time (§11). We may suspend or terminate your access if you materially breach these Terms (including the PHI rule in §3), if your account is used abusively or unlawfully, or if we are required to by law — with notice where practicable. On termination your license to use the service ends and your data is handled as described in §11 and the Privacy Policy.
18. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, DASH IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THE ACCURACY OF AI-ASSISTANT OUTPUT OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JKNIGHTSELLS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) $100. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
20. Indemnification
You will defend and indemnify JKNIGHTSELLS LLC against third-party claims arising from your content (including any PHI entered in violation of §3), your misuse of the service, or your violation of law or these Terms.
21. Governing law & disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. Before filing a claim, you agree to contact us at support@dashcheck.app and give us 30 days to work with you to resolve the dispute informally. Any dispute that can’t be resolved informally will be brought exclusively in the state or federal courts located in Lee County, Florida, and you consent to their jurisdiction — except that either party may bring an individual claim in small-claims court. TO THE EXTENT PERMITTED BY LAW, EACH PARTY WAIVES THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION; DISPUTES MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS.
22. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for material changes we will provide notice within the app or by email at least 30 days before they take effect for existing subscribers. If you don’t agree to updated Terms, cancel before they take effect (§10); your continued use of Dash after a change takes effect means you accept it.
23. Miscellaneous
These Terms, the Privacy Policy, and the plan details presented at checkout are the entire agreement between you and JKNIGHTSELLS LLC about Dash. If any part of these Terms is found unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the business. A failure to enforce a provision is not a waiver of it. Neither party is liable for delay or failure caused by events beyond its reasonable control.
